The Failure of the 28-Article Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the presentation of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of contrasting events captured the bleak nature of the outgoing year. By day, political struggles are waged: hopeful statements are issued from various governments. Significant resources is expended on restraining certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, war remains the main instrument for achieving "settlement".

Nighttime Reality

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is able to track projectile deployments from enemy soil, a ability provided through current data. From observation points, Ukrainian air force fighter jets that had been deployed to intercept incoming guided weapons flew past – modern combat jets provided to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons thundered: several firings deployed against a Russian ballistic missile. This was a advanced protection mechanism at work, presumably provided by Western nations. Every deployment creates sudden vibrations, rattling buildings. The moment of terror quickly transforms into grim resignation: possibly the approaching threat won't hit its mark this time, sparing the city from ruin and another blackout.

Ongoing Risks

Soon after, a heavy machine gun fired at a aerial vehicle close by, part of a rapid response unit – probably allied-provided weaponry. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its target.

Periodically, this carried on until dawn. Kyiv awoke to the daybreak reports: several casualties, damage and heating outages in many homes as a result of the night's assault. As customarily, everyone still went about their day – living the war. But those entire period illustrated Ukraine's vital need on international aid – a dependence that regional partners are evidently unprepared to substitute in the immediate future.

Unsuccessful Negotiations

The 28-point plan from US administration provoked deep reactions, debate and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new proposal from Washington adheres to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually secure success. This cycle will, undoubtedly, continue.

Strategic Calculations

It is tempting to accuse particular leaders of repeatedly advocating Russian terms. But that does not seem to be the complete picture. Washington works based on a premise familiar among experienced diplomats: you cannot secure via talks what you have been unable to protect through force. The American government assumes that it is unfeasible to compel Moscow to abandon the land that it currently occupies in Ukraine's southern or eastern regions.

The problem is that while accepting these circumstances, US leadership does minimal to prevent Kremlin actions, through words or deeds, from thinking that the current condition will not shift further in its benefit in the months ahead.

Conflicting Perspectives

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its partners are coming close to fatigue. Their reason to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to end hostilities, but they will persist as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, slowly losing civilians and areas but averting a complete military breakdown until circumstances change in its favour.

Existing Situation

Objectively, there are no genuine requirements for a truce. Now, subjective factors are coming into play: personal goals to mediate resolution and obtain worldwide acknowledgment, and Ukrainian leadership's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any initiative Kyiv finds unacceptable, so that their attention does not switch to domestic problems. And although their task will now be significantly challenging after latest incidents, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a just a single week to kill the suggested clauses of the latest plan. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the remaining European nations, along with calming attempts of negotiators, and finally, current information leaks, all achieved their purpose.

While new initiatives based on previous concepts are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and reflect particular unwillingness to change the course of events, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the foreseeable future, largely rely on continued Western support.
